Summary of the American Health Care Act Bill to Repeal PPACA

The AHCA marks the beginning of the process of repealing PPACA. Although House Republicans plan to move quickly on the AHCA, passage of the bill is not guaranteed. The process from bill to law can be long, arduous, and involve numerous roadblocks. As such, we caution you stay tuned for more as the flurry of activity surrounding healthcare reform continues.

Highlights of some possible changes are listed below:

  • Effectively eliminates the Employer Mandate by reducing the penalty to zero for applicable large employers effective January 1, 2016.
  • Effectively eliminates the Individual Mandate by reducing the penalty to zero for failing to maintain minimum essential coverage effective January 1, 2016.
  • Delays the effective date of the 40% Cadillac tax on high cost employer-sponsored health coverage to 2025.
  • Increases the maximum limit on annual Health Savings Account (“HSA”) contributions starting in 2018 to equal the sum of the annual deductible and out-of-pocket expenses permitted under a qualifying high deductible health plan.
  • Repeals the limit on health FSA contributions effective January 1, 2018.
  • Repeals the exclusion of over-the-counter medications as qualified medical expenses under HSAs, health FSAs, and Health Reimbursement Arrangements (“HRAs”) effective January 1, 2018.
  • Allows for a pre-existing condition surcharge on premiums for individuals that have a break in coverage of more than 63 days.
  • Repeals the health insurer tax beginning in 2018 (Note: as a result of previously enacted legislation, the tax is not being collected in 2017).
  • Rolls back the PPACA expansion of Medicaid effective January 2020.

January Client Spotlight: Madison Elementary School District

LoriThe Madison Elementary School District was established in 1890 encompassing an area of 15 square miles in Phoenix. The district’s first school, Madison School No. 1, was located at 12th Street and Missouri, surrounded by citrus groves.

Madison No. 1 was built in 1897 as the district’s first permanent facility at 16th Street and Missouri. It was originally a two-room brick building constructed by RM Gordon.  It would be the district’s only school for the next 50+ years.

As the district continued to grow, two additional schools were added: Madison No. 2 and Madison Simis.  Today, the district boasts eight schools, 900 employees and 6,000 students.

This past November, The Madison Elementary School District set out to find an employee benefits and HR consulting firm to help them get to the “next level” on their employee benefit programs.  They wanted to survey employees and the marketplace to ensure staff needs were met and the benefit plans were state of the art and competitive.  Madison also wanted to gather information and feedback from employees about what was important to them.  Together with Bagnall, a division of Gallagher Benefits, Inc., hey have formed an employee committee to spearhead the project, assess alternatives and make decisions to ensure employees are happy with their benefits.

Lori Garvey, Assistant Superintendent of Administrative Services said, “It’s so critical to us.  We wanted to find a firm that would help us make the best decisions. Bagnall, a division of Gallagher Benefits, Inc., has been absolutely wonderful.  They are with us every step of the way and extremely responsive.  After just a few short months working with Bagnall, a division of Gallagher Benefits, Inc., we can tell they are going to be a great partner.”

Currently, the district is conducting an extensive competitive bid process for all of their employee benefit plan offerings, including medical, dental, vision, life, disability and worksite benefits.  Once the procurement process is complete, the district will begin educating employees and then look at creating an employee wellness plan.

Madison Elementary School District is the only “A” rated District in the City of Phoenix.  It excels in student achievement and is known for its progressive thinking.  The District is generational, many parents have moved their families back to Central Phoenix to allow their children to experience Madison, just as they did as a child.

He says, “We began working with Bagnall about five years ago when our benefits renewal process was underway.  I had worked with Bryan Yates at a previous company and asked him to take a look at our employee benefits.  Bagnall was able to get us the same coverage for less money.  We were thrilled to be able to offer our employee the same generous benefits, while achieving a 27 percent decrease in our overall cost.”

From there, the partnership expanded to include some help with general HR consulting.  Ryan worked with Lynda McKay at Bagnall to review and update their employee handbook which was over three years out of date.  They have also worked together on some employee wellness initiatives such as offering on-site flu shot clinics to employees.

Ryan added, “I look forward to many years of collaboration with the Bagnall team.  They are a great resource and partner and we really enjoy working together.”
